Terms & Conditions
These Terms and Conditions are in addition to the Website Terms and Conditions and apply to the sale of the Institute of Positive Psychology (the IPPC) program Certified Applied Positive Psychology Coach™ (CAPPC) Level 1 (certificate) and Level 2 (diploma), herein referred to as the “program”.
Please read these Terms and Conditions carefully before purchasing the program and print a copy for your records.
If there is any conflict between our Website Terms and Conditions and the Program Specific Terms and Conditions, then the conflict shall be resolved by applying the following order of priority:
- Program Specific Terms and Conditions;
- Website Terms and Conditions.
By enrolling and paying for the IPPC’s program, you agree to the following terms and conditions.
Attendance
Attendance and participation is limited to enrolled individuals who are 18 years of age or older.
Fees and payment
The Fee for the program shall be as received in the order confirmation.
Any fees charged by your debit or credit card provider in connection with your purchase of the program are for your own account and The IPPC shall not be responsible for these.
A payment is required at the time of enrolment. The program fees are payable either:
- One time full-payment, or
- In instalments, with payments being due over a set period of time
By choosing to pay the Program fee in instalments, you agree that:
- It is your responsibility to ensure that the monthly instalment payments are made on the due dates; and
- Any failure to make payment of an instalment when due constitutes a breach of the Terms and Conditions and may result in program cancellation by the IPPC with no refund.
Access through Learning Management System
The Institute of Positive Psychology Coaching (IPPC) uses their online Learning Management System to deliver the program modules.
After the IPPC has accepted your application, you will be emailed an access link to the IPPC Learning Management System. Access to the courses will be granted after we have received your payment (full or the 1st instalment).
For live sessions offered for CAPPC Level 2 and workshops lessons will be delivered through Zoom Webinars and Meetings. It is not necessary to download Zoom beforehand, you can access the session through the learning management system.
Cancellation and Refund Policy
The IPPC reserves the right to make changes in the program structure and dates.
The IPPC also reserves the right to cancel a course or a lesson due directly or indirectly to any cause beyond the reasonable control of IPPC, its employees, or representatives, which shall include, but is not limited to, Acts of God, fire, flood, explosion, accident, civil disturbance or emergency or periods of armed conflict, government regulation or pandemic or other public health emergency.
In the event of a major technological problem that prevents or interrupts our transmission of the module broadcast, such as a power outage at our broadcast site, we will re-broadcast the lesson.
Refund Policy
For those registered in the Certificate in Applied Positive Psychology Coaching Level 1 Certificate wishing to withdraw from a course or the program, fee policy is as follows:
For those who have paid in full:
- 75% refund for registration and/or completion of one course minus $50 USD administrative fee
- 50% refund for registration and/or completion of up to two courses minus $50 USD administrative fee
- 25% refund for registration and/or completion of up to three courses minus $50 USD administrative fee
No refund for completion of four or more courses
For payment plans, monthly billing ends at the start of the next monthly payment.
- An additional $50 USD administrative fee charge will be added.
- All future private coaching sessions will also cease.
NOTE: For those who withdraw from an individual course, 72-hour notice is required in writing. Otherwise, no refund or credit toward another course will be offered.
For those registered in the Certified Applied Positive Psychology Coaching Level 2 Diploma and designation wishing to withdraw from the program, fee policy is as follows:
For those who have paid in full:
- 50% refund up to 10 days before the start of the evidence-based practicum course minus $50 USD administrative fee
- 30% refund up to 7 days after the start of the course minus $50 USD administrative fee
- No refund for after 7 days of the start of the course minus $50 USD administrative fee
For payment plans, monthly billing ends at the start of the next monthly payment.
- An additional $50 USD administrative fee charge will be added.
- All supervision sessions, bonuses and classes will also cease.
Termination
The IPPC shall be entitled to terminate the Terms and Conditions and cease to provide any Services with immediate effect in the event that:
- There is failure to pay your fees when due
- An act in an aggressive, bullying, offensive, threatening or harassing manner towards any other student, instructor, or IPPC staff or personnel.
- Cheat or plagiarise any work which you are required to prepare or submit in connection with the Services or during any examination taken in connection with the Services;
- You are in breach of the Terms and Conditions.
Proprietary Rights of IPPC
As a condition of attending the live sessions and/or viewing the recordings, you agree to the following terms and conditions (the “Terms”). If you do not agree to the Terms, do not purchase the program.
By joining a session(s), the student automatically consents to giving the Institute of Positive Psychology Coaching (IPPC) and those acting pursuant to its authority a non-exclusive grant to: (a) Record you or your voice on video, audio, photographic, digital, electronic, online formats, or on any and all other media; (b) Use your name in connection with these recordings if deemed appropriate; and (c) Use, reproduce, publish, republish, exhibit, edit, modify, or distribute, in whole or in part, these recordings in all media without compensation, for any purpose that the Institute of Positive Psychology Coaching and those acting pursuant to its authority, deem appropriate.
In addition, you release the Institute of Positive Psychology Coaching and those acting pursuant to its authority from liability, claims, and demands for any violation of any personal or proprietary right in connection with such use, including any and all claims for libel, defamation and/or invasion of privacy. All such recordings, in whatever medium, shall remain the property of the Institute of Positive Psychology Coaching.
Except as expressly authorized in writing by the IPPC, you are strictly prohibited from selling, licensing, renting, modifying, distributing, copying, reproducing, transmitting, publicly displaying or performing, publishing, adapting, editing or creating derivative works from such materials, content or other protected work product.
Reproduction, copying, creation of derivative works, or redistribution for commercial purposes of any materials or design elements of IPPC’s or presenter’s intellectual property is strictly prohibited without the express written permission of IPPC and the presenter.
Representation
Representation as a Certified Applied Positive Psychology Coach™ (CAPPC) may only be used once the designation has been conferred by the IPPC after successfully completing the full Certified Applied Positive Psychology Coaching™ program, which includes the Certificate Level 1 and Diploma Level 2.
Use of the designation prior to completion of the CAPPC program constitutes misrepresentation with direct breach of The IPPC’s Proprietary Rights.
Confidentiality
Information shared in the classes throughout the program is strictly confidential unless permission is granted by the individual(s) involved.
This clause shall continue notwithstanding termination of these terms and conditions.
Privacy Policy
Pursuant to the Canadian Anti-Spam Law (CASL) and the European Union General Data Protection Regulation (GDPR) and the California Consumer Privacy Act, the IPPC is seeking your express consent to have your electronic personal information stored in our system and to receive information regarding your activities within the program. By registering for this program, you are expressing your consent for your electronic data to be stored and to receive information regarding these activities.
Spam policy
You are strictly prohibited from using this program for illegal spam activities, including gathering email addresses and personal information from others or sending any mass commercial emails.
Damages and Liability
The IPPC accepts no liability whatsoever in respect of any loss or damage to the program attendee’s property or injury or death to the attendee’s employees, agents or representatives arising from or in connection with participation to the program.
Earnings Disclaimer
As with any training, business or individual, the results will vary. The results, testimonials, and examples used on the website https://theippc.com/ are exceptional results, and are not intended to represent or guarantee that anyone will achieve the same or similar results. Each individual’s success depends on his or her background, dedication, efforts, offerings, and motivation.
Every effort has been made to accurately represent our programs, courses, and training, and their possible potential. Any claims made of actual earnings or examples of actual results can be verified upon request. There is no assurance that examples of past earnings can be duplicated in the future. We cannot guarantee your future results and success.
As with any business endeavor, there is an inherent risk of loss of capital. Any and all forward-looking statements regarding future income potential and business results are intended to express our opinion of earnings potential. Many factors will be important in determining your actual results, and no guarantees are made that you will achieve results similar to ours or others. In fact, no guarantees are made that you will achieve any results from our ideas and techniques in our material.
Law and jurisdiction
This Agreement is subject to Canadian law and the parties submit to the exclusive jurisdiction of the Canadian courts in connection with any dispute hereunder.
